How Ownership Works: Condominium Law
Most gated developments in Costa Rica are organized under the country’s condominium law (Ley de Propiedad en Condominio) — and “condominium” here can mean a house, a lot, or an apartment. You own your unit or lot plus a share of the common areas, and you are automatically a member of the homeowners association.
What HOA Fees Cover — and What to Check
HOA dues (cuotas de mantenimiento) typically fund security, common-area maintenance, landscaping, amenity upkeep, insurance on common elements, and administration. Before buying, ask for:
- The current monthly fee and its history of increases.
- The HOA budget and whether the reserve fund is healthy.
- The condominium rules (reglamento) — short-term rental policies, pet rules, building/architectural restrictions.
- Whether dues are paid up on the specific property (unpaid HOA debt can attach to the unit).
The Trade-Offs
Rules cut both ways: they protect your investment and your peace, but they also limit what you can do — rentals, renovations, even exterior paint can be regulated. And fees are ongoing whether you use the amenities or not. Read the reglamento as carefully as you read the title.
